Who Can Register for Court Marriage?

As per the marriage association, both parties have to meet all the criteria and submit the necessary documents needed as the requirements. Note that no affidavit without those certificates shall be accepted to render the proper age.

  • From the bride\’s side, the individual must be at her minimum age of 18 years, and the groom should be at 21 years of age on an excellent marriage process.
  • Based on the Marriage Law, or following the Islamic Marriage Code, the declaration or offer of marriage gets accepted (Kabul) or signed by each party.
  • There will need required and legal identifications from both bride and groom sides. They must bring a National ID card or authentic, recognized certificates, like, Birth certificates, SSC/HSC testimonial, or resident Passport (if any).
  • There is no such mandatory attendance, but one person will need to present both individuals as Ukil or administration representor.
  • There will be needed at least two introducers as eyewitnesses to continue the process. One male and a female or witness can be two females and one male person.
  • Dower money or Den Mahar have to mention and declare by the parties or decide the amount by the guardians at the registry file.
  • For Contractual Marriage, some other layouts and deed papers need to submit in court marriage if those have validation from both parties.

How to Register for A Court Marriage? 

According to Bangladesh civil law, Judicial marriage should be enlightened through the proper marriage registration process and need to collect the marriage certificates later by any person. Usually, a Muslim Sunni Marriage Procedure and other interreligious marriages are approved to register for a court marriage. Even under the particular marriage act, 1872, Cross-religious marriage also can perform such marriage under the section of martial law in the Judicial Court of Bangladesh.

The applicants should contact a lawyer or directly visit the court magistrate for the registration procedure to formalize the marriage. Once the name is signed in the register book, the party will receive a receipt, who will need to withdraw the official marriage certificate/ Nikka Nama later. Within one month from the register day, any parties have to report to the centralized marriage registration office to complete the rest of the procedures. Otherwise, the mentioned parties will bring back to the court for some fee penalty up to 3,000/- and punishment of imprisonment at max two years. Without an authorized or certified Judicial Judge, this court marriage can\’t be performed under the Marriage and Divorce Act-1974.

How Much Does it Cost to Register for a Court Marriage Ceremony in Bangladesh?

Marriage registration fees are fixed in a percentage on Dower Money. Followed updraft chart of rate is selected according to the marriage civil law act,

  1. For per 1000/- (One Thousand Taka) of dower money, the registration fee is 12.50/- (Twelve Taka and Fifty Paisa)
  2. For per 100,000/- (One Lac Taka) of dower money, the registration fee is 1,250/- (One Thousand Two Hundred and Fifty Taka)
  3. For 400,000/- (Four Lac Taka) or more, each lac registration fee will be added with an extra 100/- (One Hundred Taka), which will be 1,350/- for the next per Lac.

This calculation shall be applicable only up to four lacs, after four lacs, and on every one Lac, 100/- shall be added to the principal fee amount.

Dower money 1 lac taka, registration fee= 1,250/-

Dower money 4 lac taka, registration fee= 5,000/-

Dower money 10 lac taka, registration fee= 5,600/-
